1. Introduction and data controller

The right to privacy, and specifically the right to the protection of personal data is one of the values of BLUEWAVE ALLIANCE, SL (hereinafter, “BLUEWAVE ALLIANCE”), which is included in our Code of Ethics.

The purpose of this policy is to explain how BLUEWAVE ALLIANCE, as data controller, will process any personal data that may be collected through the various forms that can be found on the website www.bluewavealliance.org. Your personal data will be treated confidentially as explained below in this Privacy Policy.

2. Commitment to privacy

BLUEWAVE ALLIANCE is fully committed to compliance with applicable data protection regulations, this being a priority objective for BLUEWAVE ALLIANCE.

For this reason, BLUEWAVE ALLIANCE has decided to implement the following principles, with privacy being the basis on which all processing is based:

  • Transparency, fairness and legality in the processing of data is one of our priorities, so whenever we collect personal data about you, we will duly inform you in the corresponding privacy policy of the purposes of said processing.
  • The data will always be collected for specific, explicit and legitimate purposes and will not be further processed in a manner incompatible with those purposes. 
  • We will always process data that is strictly appropriate, relevant and limited to what is necessary to carry out the reported processing, and we will never force you to provide personal data, unless it is really necessary to provide the service that you request from us.
  • The data will always be accurate and, if necessary, updated. Wherever possible, we will provide you with simple means to control your personal data. Therefore, the data will be kept in a way that allows the identification of the interested parties for no longer than necessary for the purposes of processing personal data.
  • We will process the data in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, by applying appropriate technical or organisational measures.

3. Purposes of the processing

BLUEWAVE ALLIANCE will process your personal data in order to manage your requests and offer you information that may be of interest to you. The main purposes of the processing of your personal data provided will be:

  • The attention and responses to queries and doubts raised by users. To respond to queries that users may raise through contact forms.

The legitimate basis for processing is the express consent of the interested party derived from the clear affirmative action implied by the use of the contact form. 

  • BLUEWAVE ALLIANCE, within the framework of its dissemination activity, may provide you with resources for registration or subscription to news or information regarding the activities in which it participates. Such resources will always be subject to your consent to submit them. If you have expressly authorised us to do so, BLUEWAVE ALLIANCE will send you personalised information according to your interests. To do this, we will create a profile based on the information you provide us, as well as your browsing habits.

The legitimate basis for processing is the consent of the interested party.  You may revoke your consent to receive commercial communications at any time, using the link or button provided in each of the communications, or by communicating your wish to revoke consent through the mailbox privacy@bluewavealliance.org.

On some occasions it may be necessary to process your personal data to comply with legal obligations, or in relation to any contractual relationship we may have with you. We also inform you that, with regard to processing under which the legitimate basis is your consent, you may revoke it at any time without affecting the legality of the processing carried out prior to its withdrawal. 

4.  Data communication 

Your data may be communicated to:

  • Other companies of the ISDIN Group for internal administrative purposes based on our legitimate interest to manage the business globally or even, when necessary, to other partners of the organisation for the execution of the contractual relationship we maintain with you. 
  • To certain suppliers who provide services to our company, such as sending personalised commercial communications, data storage or web pages, but who will under no circumstances process the data for their own purposes. 
  • Competent judicial and/or administrative authorities: (i) if required by law or legal process, or (ii) in response to a request from competent public authorities, or (iii) within the framework of a judicial or administrative procedure.

5. International transfers of personal data 

Some of the recipients mentioned in the previous section may be located in countries that are not considered to have an adequate level of protection (such as the United States, China or LATAM countries, including Mexico and Colombia). For example, it may be necessary to provide such data to international service providers, either because of the need to provide you with the requested service, or to be able to provide you with the service with the highest quality standards.

In any case, BLUEWAVE ALLIANCE will ensure that the relevant guarantees are applied in accordance with the requirements of the applicable regulations, so that your data is adequately protected, which may include:

  1. Standard clauses approved by the EU: these are contracts approved by the European regulator, and which provide sufficient guarantees to ensure that the treatment complies with the requirements established by the European Data Protection Regulation.

6. Duration of processing and storage period

We aim to offer you a quality service through its use. We will therefore make all reasonable efforts to minimise the processing and storage time of personal data.

In this regard, your data will be retained, in general, for the duration of the relationship with you (i.e., your subscription) and, subsequently, for the maximum limitation period in which any liability may arise from your consultation or the use of our products and, in any case, for the legally established period. 

However, for processing based on your consent (for example, receiving marketing communications), we will retain your personal data until you withdraw that consent or, for processing of personal data based on our legitimate interest, we will retain it until you object to such processing (and as long as our legitimate interest overrides your interests and rights). 

In any case, even if you ask us to delete your data, we may retain it and keep it under proper security, for the period necessary to comply with our legal obligations and to make it available to the authorities with jurisdiction in the various applicable matters.

7. Exercise of rights and claims 

As a result of the processing of your personal data by BLUEWAVE ALLIANCE, current legislation grants you a series of rights. Below we offer a brief explanation of each right, to help you exercise it:

  1. Right of access: you have the right to obtain confirmation as to whether or not BLUEWAVE ALLIANCE is processing your personal data, as well as to access such personal data. 
  2. Right of rectification: your data will always be yours, and as such, you can ask us to rectify it at any time if the data in our records is inaccurate or incomplete.
  3. Right to erasure: you may request, at any time, that your personal data be deleted from our files. However, as indicated in the data retention section above, please note that in certain circumstances, compliance with current legislation may prevent the effective exercise of this right.
  4. Right to object: you may object to the processing of your data at any time for reasons relating to your particular situation, when such data is being processed based on a mission of public interest or legitimate interest.
  5. Right not to be subject to automated individual decisions, including profiling, which produces legal effects concerning you or similarly significantly affects you. 
  6. Right to restriction of processing: you may request that the processing of your data be limited under certain circumstances, in which case we will only retain it for the exercise or defence of claims. 
  7. Right to data portability: you have the right, under certain circumstances, to receive your personal data in a structured, commonly used and machine-readable format and to transmit it to another controller.

Whenever we process your data based on consent, you may also revoke it at any time.

Please note that, in any case, you may file a claim with the competent authority in matters of data protection if you consider that we have not processed your data lawfully or that we have not attended to your requests or rights. 8. Confidentiality and security in data processing

Your personal data is very important to us, and we are committed to processing it with the utmost confidentiality and discretion, as well as implementing all security measures that we consider appropriate and reasonable.

In this regard, BLUEWAVE ALLIANCE declares and guarantees that it has established all technical means at its disposal to prevent the loss, misuse, alteration, unauthorised access and theft of the data provided by users.

9. Social Media

Social media is part of the daily lives of many Internet users, and we have created different BLUEWAVE ALLIANCE profiles for them.

All users have the opportunity to join the pages or groups that BLUEWAVE ALLIANCE has on different social networks.

However, you should bear in mind that, unless we request your data directly (for example, through marketing actions, contests, promotions, or any other valid means), your data will belong to the corresponding social media channel, so we recommend that you carefully read their terms of use and privacy policies, as well as make sure to configure your preferences regarding the processing of data.
