2. User acceptance

These conditions of use (hereinafter the “Conditions”) regulate the access and use of the website www.bluewavealliance.org (hereinafter the “Website” or “Web”) that BLUEWAVE ALLIANCE makes available to Internet users. The User is understood to be the person who accesses, browses, uses or takes part in the services and activities of the Website.

Access to the Web implies unreserved acceptance of these Conditions.

BLUEWAVE ALLIANCE may offer temporary services or actions through the Website, which will be subject, where applicable, to Specific Conditions, and which will be made known to the Users in each specific case. If the Specific Conditions established in each case do not address the particular subject in question, the provisions of these Conditions will apply. In the event of any discrepancy between them, the Specific Conditions will apply.

3. Correct use of the Website

BLUEWAVE ALLIANCE may make available to Users, either on its own Website or on satellite pages owned by it, interactive spaces such as blogs, forums and spaces for communication between registered Users related to the protection of the Mediterranean Sea. To do so, you must adhere to the following at all times:

  • The protection of data of other persons or entities to which it may refer.
  • Using the contents and services of the Website in accordance with the Law, these Conditions, good practices and public order.
  • Do not express political or xenophobic tendencies.
  • Always show respectful behaviour regarding the opinions and comments of third parties.
  • Do not make abusive, defamatory, sexually explicit or threatening comments.
  • Do not make false, inaccurate or incorrect statements or indications about BLUEWAVE ALLIANCE, its directors, its employees, the Website or the contents.
  • Do not publish images of third parties (neither adults nor minors) without first obtaining their consent and without complying with the applicable legislation.
  • Do not destroy, alter, render useless or in any other way damage the data, programmes or electronic documents found on the Website.

Likewise, BLUEWAVE ALLIANCE reserves the right to unilaterally remove any content, such as, but not limited to, comments, texts, videos and/or photographs, hosted in any section of the Website, when there are indications that said content infringes any legal provision, violates the rights of third parties, or is used for advertising purposes (SPAM), as well as when BLUEWAVE ALLIANCE deems it appropriate.

Any repeated or serious violation of the Conditions described above, as well as any violations that may constitute a violation of the Laws, morality, good faith, public order or the principles governing the activities of BLUEWAVE ALLIANCE, will entail the loss of the right to access the Website, as well as any legal action that BLUEWAVE ALLIANCE may decide to take.

The Website may contain advertising or sponsored content. Advertisers and sponsors will, in this case, be solely responsible for ensuring that the material submitted for inclusion on the Website complies with the laws that may be applicable in each case.

BLUEWAVE ALLIANCE does not guarantee or assume any type of responsibility for damages suffered by accessing third-party content through connections, links or RSS of the linked sites.

Links are provided solely to inform the User of the existence of other sources of information on a particular subject, and the inclusion of a link does not imply endorsement of the linked website by BLUEWAVE ALLIANCE.

6. Intellectual and industrial property

All content on the Website, such as, but not limited to, the graphic design, source code, logos, texts, graphics, illustrations, photographs, and other elements that appear on the Website, are the exclusive property of BLUEWAVE ALLIANCE, or BLUEWAVE ALLIANCE has the necessary licences for their use. BLUEWAVE ALLIANCE is, therefore, the owner of the intellectual and industrial property rights derived or that may be derived from the contents, which are protected by the national and international legislation in force at all times.  

BLUEWAVE ALLIANCE does not, in general, grant any type of licence or authorisation of use to the User over its intellectual and industrial property rights or over any other right related to its Website and the services offered therein.

Therefore, the User acknowledges that the reproduction, distribution, commercialisation, transformation, and in general, any other form of exploitation, by any procedure, of all or part of the contents of this Website constitutes an infringement of the intellectual and/or industrial property rights of BLUEWAVE ALLIANCE or the owner thereof.

7. Scope of liability

7.1. Responsibility for the use of the Website

The User is solely responsible for any infringements that may occur or any damages that may be caused by the use of the Website, with BLUEWAVE ALLIANCE, its partners, companies of the group, collaborators, employees and representatives being exonerated from any type of liability that may arise from the actions of the User.

BLUEWAVE ALLIANCE will use all reasonable efforts and means to provide up-to-date and reliable information on the Website. However, BLUEWAVE ALLIANCE does not assume any guarantee in relation to the presence of errors or possible inaccuracies and/or omissions in any of the content accessible through this Website.

The User is solely responsible for any claim or legal action, judicial or extrajudicial, initiated by third parties against BLUEWAVE ALLIANCE based on the use of the Website by the User. Where applicable, the User shall assume all expenses, costs and compensation incurred by BLUEWAVE ALLIANCE as a result of such claims or legal actions.

7.2. Responsibility for the operation of the Website

BLUEWAVE ALLIANCE excludes all liability that may arise from interference, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operational functioning of the electronic system.

Likewise, any liability that may arise from delays or blockages in the operational functioning of this electronic system caused by deficiencies or overload in the telephone lines or the Internet, as well as damages caused by third parties through illegitimate interference beyond the control of BLUEWAVE ALLIANCE, is also excluded.

BLUEWAVE ALLIANCE is authorised to temporarily suspend, without prior notice, accessibility to the Website for maintenance, repair, updating or improvement purposes.

7.3. Liability for content

BLUEWAVE ALLIANCE shall not be liable, except in those cases where required by law, for any damage or loss that may be caused by the use, reproduction, distribution or public communication or transformation and any type of activity carried out on the contents of the Website without the User having previously obtained the necessary authorisation from its owners to perform the use that is carried out or intended to be carried out.

The User will be liable for any damages of any kind that BLUEWAVE ALLIANCE may suffer, directly or indirectly, as a result of the User's failure to comply with any of the obligations arising from the Conditions of Use, internal policies of BLUEWAVE ALLIANCE, and/or current legislation in relation to the use of the contents of the Website.

BLUEWAVE ALLIANCE reserves the right to develop or update the Conditions of Use of this Website at any time, therefore the User must read them periodically.

9. Withdrawal and suspension from the Website

BLUEWAVE ALLIANCE may withdraw or suspend at any time and without prior notice the provision of the Web services to those Users who fail to comply with the provisions of these Conditions.

10. Codes of conduct

BLUEWAVE ALLIANCE is committed to complying with the provisions set out in the codes of conduct to which its members adhere, including the Pharmaceutical Industry Code of Good Practice 2014, and thus ensuring that the conduct of BLUEWAVE ALLIANCE is always ethical, professional and responsible.

BLUEWAVE ALLIANCE will pursue any breach of these Conditions as well as any improper use of the Website by exercising all civil and criminal actions that may apply and are available under the law.
